In today's complex landscape of fair housing regulations, property managers and landlords must navigate the delicate balance between ensuring safety and security for tenants while upholding fair housing principles. Criminal background checks are a common practice in screening prospective tenants, but if not conducted with care, they can inadvertently lead to discrimination and fair housing violations.
This session will offer practical guidance and actionable strategies for conducting criminal background checks in a manner that is both effective and compliant with fair housing regulations. We’ll detail nine important elements to minimize the risk of discrimination and increase equity in the resident screening process and suggest specific strategies for conducting effective and compliant criminal background checks.
We’ll examine the HUD guidance governing criminal background checks in order for you to gain a clear understanding of the how the Fair Housing Act impacts screening practices, especially the importance of considering disparate impact and avoiding blanket policies that disproportionately impact protected classes. We’ll also explore so called “Fair Chance” laws and conditional offers to lease. Don’t miss this important session!
